Terms of service
These terms are an agreement between Easy E-Commerce Inc. ("Nexus Fulfill", "we", "us") and the business that signs up for Nexus Fulfill ("you"). By creating an account or using the service, you agree to them on behalf of your business.
1. The service
Nexus Fulfill is web-based software for managing, shipping and fulfilling orders from online sales channels, together with a desktop print app. We may improve and change the service over time. If we remove a feature you rely on, we will tell you in advance.
2. Accounts
- Accounts are created by invitation or after we approve a request for access.
- You are responsible for the people you invite to your account and the roles you give them. Each person must use their own login; logins may not be shared.
- Keep your credentials secure and tell us right away at [email protected] if you suspect unauthorized access.
3. Connected sales channels and carriers
- When you connect a marketplace, store or carrier account, you authorize us to access it on your behalf to provide the service.
- You must have the right to connect each account, and you remain bound by each provider's own terms and policies. You are responsible for your use of those accounts through Nexus Fulfill.
- Postage and carrier charges are billed to you by your carrier under your carrier account. We do not mark up or collect postage.
- You can disconnect any account at any time, which ends our access to it.
4. Your data
- You own the data you bring into Nexus Fulfill, including your orders and your customers' information. You give us permission to process it only to provide and secure the service, as described in our privacy policy.
- You agree to use buyer information obtained through the service only to fulfill, ship and support the related orders, and in line with the policies of the channel it came from.
- You can export your data or ask us to delete it at any time.
5. Acceptable use
You agree not to: use the service to break any law or any sales channel's or carrier's policies; use buyer information for marketing or any purpose other than fulfilling the order; attempt to access other customers' data; interfere with or overload the service; reverse engineer it; or resell it without our written permission.
6. Fees and billing
- Subscription fees are set out in your written quote and billed monthly in advance, in USD.
- You can cancel at any time; cancellation takes effect at the end of the current billing month. Fees already paid are not refunded except where the law requires.
- We will give you at least 30 days' notice before changing your price.
7. Availability and support
We work to keep Nexus Fulfill available and to fix problems quickly, and we provide support by email and phone during business hours. Planned maintenance is scheduled outside peak shipping hours where possible.
8. Suspension and termination
We may suspend access if your account is used in a way that breaks these terms, puts other users or data at risk, or if fees remain unpaid after notice. Either party may end the agreement by cancelling the account. After termination you can request an export of your data for 30 days, after which it is deleted.
9. Warranties and liability
The service is provided "as is". We do not guarantee carrier rates, delivery times or the availability of third-party services, which are outside our control. To the extent the law allows, neither party is liable for indirect or consequential losses, and our total liability for any claim is limited to the fees you paid us in the 12 months before the claim.
10. Changes to these terms
We may update these terms. For material changes we will notify you at least 30 days in advance by email or in the app. Continuing to use the service after the change takes effect means you accept the updated terms.
11. Governing law
These terms are governed by the laws of the state in which Easy E-Commerce Inc. is incorporated, without regard to conflict of law rules.
